CROSSTATE AUCTIONEERS TERMS & CONDITIONS                         

The highest accepted bidder shall be the purchaser. The Auctioneer has the right to regulate the bidding. He may furthermore withdraw any item at any time. The Auctioneer does not hold himself responsible for any errors of description. A bid shall be taken as proof that the bidder has made himself/herself acquainted with the lots for which he/she bids. Lots once knocked down are and remain at the risk of the Purchaser. All bids are exclusive of VAT. All sales are final and voetstoots. The purchaser shall not be entitled to possession of any of his purchases until the total purchase price of all his purchases has been fully paid. The purchase price shall be payable by the purchaser to the auctioneer in full immediately on the goods being knocked down to the purchaser.

In the event of the purchaser (1) failing to make payment of the purchase price as aforesaid; or (2) failing to comply strictly with any other obligation in terms hereof, the Auctioneers shall retain a possessory lien over the relevant goods and shall furthermore, without notice to the purchaser have the right to resell such goods on behalf of the purchaser by public auction or private treaty alternatively the auctioneers shall have the right to cancel the sale forthwith and without notice and resell the goods on behalf of the Seller by public auction or private treaty. Should the auctioneers resell any lot, the original purchaser shall forthwith upon demand, pay to the auctioneers, as damages any deficiency arising from the resale. The purchaser shall be bound by all announcements made by the auctioneer at the commencement of and during the sale whether or not he is present at the time of making such announcements. In the event of the seller or the auctioneer personally or on behalf of the seller instituting legal proceedings against the purchaser the following provisions shall apply, (a) Such proceedings may at the election of the seller or the auctioneer be instituted in a magistrates court having jurisdiction over the person of the purchaser in terms of Section 28 of the magistrates court act no. 32 of 1944 not withstanding the fact that the claim or the value of the matter in dispute might exceed the jurisdiction of such magistrates court and (b) the seller or the auctioneer as the case may be shall be entitled to claim payment of the legal costs from the purchaser on an attorney and client basis, and (c) The Purchaser shall be deemed to have selected and appointed as his domicilium citandi et executandi the address inserted by him on the buyers cards signed by him. (d) A Certificate issued under the hand of the auctioneer setting forth the amount of the purchasers indebtedness in respect of the purchase price due by the purchaser arising from and out of any sale by the auctioneer shall constitute conclusive proof of such indebtedness by the purchaser and shall further constitute a liquid document for the purpose of provisional sentence, summary judgement or otherwise.

The purchaser should he sign these conditions and/or be the successful bidder on any lot/s in a representative capacity, hereby binds himself as surety and co-principal debtor for all the obligations of the concern he represents. Terms: Bank guaranteed cheques or bank cheques or electronic funds transfer.

The auctioneer will have the right, in respect of goods not timeously paid for and / or not immediately removed when paid for, to charge the purchaser in respect of storage thereof at the rate of R25-00 per day which the Purchaser will be obligated to pay before removing the goods.

THE PRICE YOU BID EXCLUDES 8% BUYERS COMMISSION AND EXCLUDES A R1,750- DOCUMENTATION FEE.

BOTH CHARGES ARE EXCLUSIVE OF 14% VAT

ANY VEHICLE WITH SIGNWRITING WILL NEED TO HAVE SIGNWRITING REMOVED

TAUTLINER CURTAINS WITH SIGNWRITING – THE ENTIRE CURTAIN NEEDS TO BE REMOVED

ANY TRACKING DEVICES NEED TO BE REMOVED (PLEASE ARRANGE THE ABOVE WITH THE AUCTIONEER)

THERE WILL BE SOME PAPER DELAYS – IF THE NATIS DOCUMENT IS NOT IN OUR POSSESSION, WE WILL REQUEST IT FROM THE SELLER AND FORWARD IT TO YOU AS SOON AS POSSIBLE

THIS AUCTION IS CONDUCTED IN TERMS OF SECTION 45 (4) OF THE CONSUMER PROTECTION ACT WHICH EXCLUDES SECTION 55 AND 56

EVERY ITEM ON THE AUCTION SALE IS SUBJECT TO A RESERVE / UPSET PRICE

THE AUCTION IS SUBJECT TO A RIGHT TO BID BY OR ON BEHALF OF THE OWNER OR AUCTIONEER, IN WHICH CASE THE OWNER OR AUCTIONEER, OR ANY ONE PERSON ON BEHALF OF THE OWNER OR AUCTIONEERS AS THE CASE MAY BE, MAY BID AT THE AUCTION

THE KILOMETRES AND HOURS ON ALL ITEMS ARE NOT GUARANTEED BY THE AUCTIONEER

FICA REQUIREMENTS MUST BE MET BEFORE ANY ABSA BANK (LTD) UNIT WILL BE RELEASED.
