PLEASE REMEMBER not to bid unless you can (if successful) pay & collect by 4pm on Friday 13th May - we do not package, post or deliver lots, no matter what their size.

 

These lots are being sold on behalf of a trustee and Liquidators of Asset Products (Eastbourne) and others.

 

VIEWING: Strictly by Appointment, Monday - Friday, between the hours of 10.00am & 4.30pm.

 

All lots located at ECA, 46 Brampton Road, Eastbourne, BN22 9BN.  No children under 16 permitted on the premises.

 

BIDDING STARTS: Monday 25th April 2016 from 10am

BIDDING CLOSES: Friday 6th May 2016 at 12 Noon

 

IMPORTANT: All bids are legally binding.

 

1) REGISTRATION

You must first register with BidSpotter to set up an account, then ‘sign up’ to each specific auction you wish to bid in. Please ensure you read & understand the rules of each auction that you sign up to, in particular to ensure that you can pay & collect within the timescale of that specific sale.

 

ECA use a manual approval system, meaning each buyer must be individually approved before they can bid. Your credit card details are used for the purposes of an identity check.

 

If you fail the I.D. check and/or have no bidding history and/or have one or more incidents where you have failed to pay any BidSpotter auctioneer and/or you are based overseas, you are likely to either be declined or sent a refundable deposit request.

 

Please therefore ensure that you sign-up well in advance of the sale – if you wait until the day the sale is closing before signing up to the sale, there is a strong chance you will not be approved in time to bid.

 

Remember all bids are legally binding. Also please remember that we will not change the bidders details on the invoice so you must register in the name you wish the invoice to be addressed to.

 

Do not give your password to anyone else – it is NOT a valid excuse post-sale to claim a relative/employee/partner/friend/etc bid on your account without your permission – the registrant will still be held liable for all bidding activity.

 

 

 

2) BIDDING

 

All lots are sold as seen - it is assumed in the act of bidding that all bidders have viewed lots prior. No allowances of any description whatsoever will be made in the event of problems as a result of failure to view - it is our strong advice not to bid on anything at all if you have not viewed to your satisfaction first - our descriptions and photos are insufficient to rely wholly upon for the purposes of bidding

 

Please note this sale will use `auto bid extension`. If a bid is placed with less than 10 minutes remaining (for that specific lot only) the end time automatically extends by a further 10 minutes. This will keep occurring until there is a 10 minute period with no bids.

 

RESERVES: All lots have a (normally modest) reserve. Until the bidding passes the reserve, the lot will indicate ‘reserve not met’. We do not issue guide prices or indications of the reserve level. We may lower the reserve during the auction. If bidding has already started on a lot, that means you may see ‘reserve not met’ at the time you bid, but then at a later stage find you have been successful if the reserve is lowered to meet your bid.

 

3) BUYER’S PREMIUM & VAT

 

All lots are subject to VAT unless the vendor is not VAT registered OR the item is zero rated. Each lot has a note in the top right hand corner of whether there is 0% or 20% VAT.

 

A Buyer's Premium of 20% is applied to all lots regardless of whether the lot price itself is exempt from VAT. Buyer's Premium is always subject to VAT which can never be zero rated or refunded, even for exporters.

 

Those wishing to export and potentially claim back the VAT on the hammer price should read our full terms & conditions for further details. WE CAN NEVER refund or zero rate the VAT for purchasers using a UK address on BidSpotter. If you don't inform us at the time of payment that you may be reclaiming the VAT, it will probably not be possible to claim a refund, regardless of whether you have ticked the 'VAT exempt' box when registering.

 

4) PAYMENT & COLLECTION

 

Balances must be paid in full & all goods collected by 4pm on Friday 13th May 2016 – if in any doubt as to your ability to comply, do not bid.

 

If the sale ends early enough, limited payment & collection may be possible on the day the sale ends however we recommend waiting until the morning following the sale before visiting.

 

You will receive a ‘winning bidder notification’ email shortly after the last lot closes, with details of the lots purchased & total balance. You will also receive a ‘payment request’ email, shortly after the ‘winning bidder notification’. You may use the ‘payment request’ email to pay online by Bank transfer.

 

Alternatively, you may pay by cash, bank transfer or debit card in person – please see the full terms for further details.

 

DEBIT CARD CHARGES: PLEASE NOTE a change in our rules & charges. ALL cards other than UK debit cards will be subject to a 3% surcharge. As at 1st September 2014, we will no longer take card payments over the phone.

 

COLLECTION DEADLINE: YOU WILL BE CHARGED a late collection/payment charge if you do not collect in time. It is deliberately high in the hope that buyers will make every possible effort to pay & collect promptly.

 

WE DO NOT IN ANY WAY, SHAPE OR FORM ASSIST WITH POSTAGE OR PACKAGING - PLEASE BEAR THIS IN MIND BEFORE BIDDING. We do not supply boxes or packing materials, nor do we deliver.

 

This means if you send a carrier (or attend to uplift in person), you must remember we will not put the lot/s you have won in a box/bag/envelope, seal/tape up a box, lend tools to help dismantle machinery, load items on a pallet, shrink wrap pallets/items, label anything, weigh lots or indeed do anything other than point you/your carrier in the direction of the lots in question and supervise their removal. If this will pose a problem, DO NOT BID. After every sale, at least one bidder will ask us to ‘bend the rules’ giving a most compelling reason for same. THIS MEANS WE WILL NOT ASSIST IN THE DISPATCH OR COLLECTION OF LOTS – NO EXCEPTIONS – Do not ask for an exception to be made as our refusal may offend.

 

Assuming the goods are located at our premises, we may be able to offer the use of our Fork Lift Truck, strictly subject to our staff being comfortable that the lot/s in question are ‘a safe load’ – this does not mean that we will load goods onto a pallet, it means we will use our fork lift to lift a pallet (or piece of plant, etc). If you wish to take one or more of our pallets and/or have the use of our Fork Lift Truck & driver, this will be subject to a charge – it your carrier refuses to pay us, we will not assist in this way.

Terms & Conditions

Standard Conditions of Sale

 

1. The highest bidder for each lot shall be the Purchaser and, in the event of any dispute, the Auctioneers shall have absolute discretion either to settle such dispute or to re-offer the lot immediately.

 

2. No person may advance less at a bid than a sum to be named from time to time by the Auctioneer, nor shall any bidding be retracted. The Auctioneer may, without giving any reason therefore, refuse to accept the bidding of any person or persons.

 

3. All lots are put up for sale subject to any reserve price placed by the Vendors, who may bid for any lot or lots, and may withdraw any lot or lots, either personally or through the Auctioneer or through any other person, as many times as they respectively may think fit.

 

4. Each Purchaser shall give his or her name and address in writing (if required) to the Auctioneer at the Sale and pay the full purchase money at the close of the Sale or, if required, the whole or a portion of the purchase money, as the Auctioneer may determine, during the course of the Sale. If any Purchaser fails to comply with any of these conditions the lot or lots in respect of which such failure is made may, if the Auctioneer thinks fit, be put up again and resold. If upon such resale a lower price is obtained for any such lots than was obtained on the first sale the difference in price shall be a debt due from the Purchaser in default upon the first sale.

 

5. No lot or lots shall be removed from the premises until paid for, but each and every lot shall immediately at the fall of the hammer be considered as delivered and be and remain in every respect at the absolute risk of the respective Purchaser or Purchasers thereof, and shall be removed at the Purchaser`s expense after the conclusion of the Sale and taken with all faults or errors of description.

 

6. The Auctioneers act only as agents for the Vendor(s) and are not responsible for any default by either Vendor{s) or Purchaser. In particular, they shall not be liable to pay the Vendor until payment is received from the Purchaser.

 

7. No undertaking of the Auctioneers or their employees to take charge of any lots after the sale or to forward them to their destination shall be held to impose upon the Auctioneers any legal obligation or vitiate any of the foregoing conditions.

 

8. Purchasers you may pay by cash, bank transfer or debit card in person.

9. In all cases of transfer the original Purchaser shall be held responsible for the purchase money.

 

10. The Auctioneer reserves the right to withdraw or divide any lot or to combine any two or more lots at his sole discretion and to sell in such order as he may think fit.

 

11. The Auctioneers have described the lots to the best of their ability and belief from information furnished by the Vendors who shall be alone responsible for any error or mis-statement, which there may be. The Auctioneers undertake no liability whatever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any lot and all statements as to these matters whether contained in the catalogue or made orally are statements of opinion only and are not to be taken as being or implying a statement or representation of fact. Any intending Purchaser must satisfy himself by inspection or otherwise as to the correctness of each such statement. The Vendor does not make or give and neither the Auctioneers, nor any person in their employ, have any authority to make or give any representation or warranty in relation to any of the lots without the express instructions of the Vendor(s).

 

12. The Auctioneers accept no responsibility in connection with the commissioning of their staff to bid for any lots. Reserves and commissions given verbally or by telephone are accepted at the sender`s risk and must be confirmed in writing before the Sale.

 

13. THIRD PARTY LIABILITY. All persons on the Auctioneers` premises before, during or after the Sale shall be deemed to be there at their own risk and with notice of the condition of the premises and of the method of arranging lots and shall have no claim against the Auctioneers in respect of any injury or accident which may occur from any cause whatsoever.

 

14. If any Purchaser shall fail to comply with the above conditions or any of them, the Auctioneers shall be at liberty to recover in full the amount of the purchase money of the lot or lots bought by such Purchaser together with all interest, costs, charges and expenses, without reference to any delivery or acceptance of the lot or lots, other than the first delivery by the fall of the hammer, or to resell any lot or lots bought by such Purchasers, either by public or private sale, and the full amount of the purchase money at the present sale, or the deficiency (if any) arising from the second sale, together with all interest, costs, charges and expenses, shall be made good by the defaulter and be recoverable as and for liquidated damages.
