Important Information

Please note that Lots 1 - 85 are based at the university and the remaining lots are based in Blackburn about 40 minutes drive away. Please note all lot except for lots 1 and 4 have been disconnected and are ready to move, there is a large service lift directly into the kitchen that goes down to the loading bay

Delivery is offered on goods that can be palletised or boxed otherwise you will need to arrange collection.

Viewing will be by appointment only for Manchester please call our office to arrange and Blackburn any weekday by apointment with ourselves.

Collection From Manchester will be Friday 25th April Only except for the large servery counters and bar which can be removed via appointment. This collection day is strict and you will not have any further opportunity to collect from this site after this date please do not bid if you cannot collect on this day.

 Blackburn collection is between Wednesday 23rd and Friday 25th April.

Payment is due in full within 24 hours of the auction ending, please note we do not take payment directly from your registered card you need to pay via bacs or call our office with a debit card.

Terms & Conditions

 

  • The auctioneers sell as agents for the seller except where they are stated wholly or partly to own any lot as principal and as such are not responsible for any default by seller or buyer. Subject to clause 18 neither the seller nor the buyer shall have any legal right of action against the auctioneers in respect of any cause or matter arising out of a sale.
  • Any reference to the age of a motor vehicle in the particulars relating to it is intended to be a reference to the year of first registration of the motor vehicle in the United Kingdom.
  • All lots are sold with all faults and imperfections and errors of description. Illustrations in catalogues or brochures are for identification only. Buyers should satisfy themselves prior to sale as to the condition of each lot and should exercise and rely on their own judgment as to whether the lot accords with its description. Neither the seller, auctioneers, their servants or agents are responsible for errors of description or for the genuineness or authenticity of any lot; no warranty is given by the auctioneers, their servants or agents or by any seller to any buyer in respect of any lot and any express or implied conditions or warranties are excluded.
  • The seller warrants to the auctioneers and to the buyer that he is the true owner of the lot or is properly authorised to sell the lot by the true owner and is able to transfer a good and marketable title to the lot free from any third party claims. The seller will indemnify the auctioneers, their servants and agents and the buyer against any loss or damage suffered by them in consequence of any breach of the above warranty on the part of the seller.
  • The auctioneers shall have the right, at their discretion, to refuse admission to their premises or attendance at their auctions of any persons.
  • The auctioneers have absolute discretion without giving any reason to refuse any bid, to divide any lot, to combine any two or more lots, to withdraw any lot from the auction and in case of dispute to put up any lot for auction again.
  • The seller shall be entitled prior to the auction to place a reserve price on any lot. A reserve price once placed by the seller shall not be changed without the consent of the auctioneers. Where a reserve price has been placed, only the auctioneers may bid on behalf of the seller. Where no reserve has been placed, the seller may bid either personally or through the agency of any one person.
  • The auctioneers shall have the right to refuse any bid which does not exceed the previous bid.
  • The highest bidder shall be the buyer. Any dispute as to any bid shall be settled at the auctioneer's absolute discretion. Every bidder shall be deemed to act as principal unless there is in force a written acknowledgement by the auctioneers that he acts as agent on behalf of a named principal.
  • Immediately a lot is sold the buyer must:
    1. give to the auctioneers his name and address and, if so requested, proof of identity; and
    2. pay to the auctioneers a non-refundable deposit ( If Required)on the purchase price in the amount advertised from time to time with the balance of the purchase price (plus VAT if applicable) payable in cleared funds within 2 working days thereafter.
  • The ownership of the lot purchased shall not pass to the buyer until he has made payment in full in cleared funds to the auctioneers of the purchase price (and any VAT thereon if applicable).
  • The buyer shall at his own expense take away the lot purchased not later than 2 working days after the day of the auction but not before payment to the auctioneers of the purchase price. The buyer shall be responsible for any removal, storage and insurance charges on any lot not taken away within 2 working days after the day of the auction.
  • The buyer will be responsible for loss or damage to the lots purchased from the time of collection or the expiry of 2 working days after the day of the auction, whichever is the sooner, and neither the auctioneers nor their servants or agents shall afterwards be responsible for any loss or damage of any kind, whether caused by negligence or otherwise, while any lot is in their custody or under their control.
  • The buyer of any motor vehicle is responsible for complying with all legal requirements as to the construction and use of that vehicle and for obtaining all certificates, permits or other authorisations necessary before that vehicle can be used on any road.
  • If any lot is not paid for in full and taken away in accordance with the above conditions, or if there is any other breach of these conditions, the auctioneers as the agents of the seller shall at their absolute discretion and without prejudice to any other rights they may have, be entitled to exercise one or more of the following rights or remedies, that is to say:
    1. to proceed against any buyer for damages for breach of contract;
    2. to rescind the sale of that or any other lot sold to the defaulting buyer at the same time or any other auction but without prejudice to the auctioneer's right to retain the deposit paid on the lot;
    3. to resell the lot or cause it to be resold by public auction or private sale. The defaulting buyer shall then pay to the auctioneers any resulting deficiency in the purchase price at the first auction after deduction of any part payment and addition of resale costs. Any surplus shall belong to the seller;
    4. to remove, store (either at the auctioneer's premises or elsewhere) and insure the lot at the expense of the defaulting buyer.
    5. to charge interest at a rate not exceeding 1.5% per month on the purchase price to the extent that it remains unpaid for more than 2 working days after the day of the auction;
    6. to retain that or any other lot sold to the same buyer at the same or any other auction and release it only after payment of the purchase price;
    7. to reject or ignore any bids made by or on behalf of the defaulting buyer at any future auction or to obtain a deposit for accepting any bids in future.
    8. to apply any proceeds of sale then due or at any time afterwards becoming due to the defaulting buyer towards settlement of the purchase price and to exercise a lien on any property of the defaulting buyer which is in the auctioneers' possession for any purpose.
  • In all cases, the lot shall remain at all times at the risk of the seller and neither the auctioneers nor their servants or agents will be responsible for any loss or damage whether caused by negligence or otherwise.
  • The buyer shall not be entitled to assign the benefit of any contract entered into by virtue of successful bid at an auction and shall not sub-sell any lot until payment has been made in full.
  • If the buyer pays to the auctioneer a buyer's fee in respect of defect in title of any lot in an amount as advertised from time to time at the auctioneers premises on the day of the sale the auctioneer shall indemnify the buyer against any defect(s) in title of the lot of which the buyer was not aware at the time of the sale PROVIDED THAT:
    1. such defect(s) are notified to the auctioneer in writing within six months of the time of sale
    2. any sum payable to the buyer by the auctioneer under this clause shall be strictly limited to the purchase price of the lot and the auctioneer shall not be liable to the buyer for any other loss suffered by the buyer whatsoever
    3. in the event of a payment being made by the auctioneer pursuant to this clause the buyer hereby authorises the auctioneer to take any court actions against the seller or third parties the auctioneer considers appropriate in the name of the buyer in order to recover any sum
  • The seller authorises the auctioneers to deduct commission (plus any VAT chargeable thereon) from the purchase price.
  • The auctioneers shall remit the proceeds of the sale to the seller not later than 7 working days after the auction.
  • Where a seller cancels instructions for sale or the auctioneers are unable to sell due to misdescription of the lot by the seller, the auctioneers reserve the right to charge a fee equivalent to the commission percentage charged from time to time of the auctioneers' then latest estimate of the auction price of the property withdrawn, plus VAT.
  • In these Terms and Conditions the following words shall have the following meanings: "auctioneer" means Phillip Diver Auctioneers, Unit 21, Park farm Ind est, Greet, Cheltenham, Gloucs, GL54 5BX
  • "seller" means the owner of a vehicle or its authorised agent and any other person offering a vehicle for sale to the Auctioneer whether authorised by the owner of the vehicle or not.
  • "buyer" includes the person to whom the car is sold by private treaty, the highest bidder at auction, the person declared by the Auctioneer as the buyer and if any of the aforesaid persons are acting for a third party principal, that third party principal. "vehicle" or "lot" shall include all motor cars, motor vehicles, motorcycles, car parts and accessories entered for sale whether by private treaty or public auction.
  • These Terms and Conditions supersede all previous terms and conditions.
  • The sale of all goods falls outside the sale of goods act. Please see the citizens advice guide buying at auction for clarity on this point.
