All payments due strictly within 48 hours of auction end (ie. By 5pm Monday 16th March) or a 10% administrative charge will be added to all invoices. Please be reminded that ALL BIDS ARE BINDING and that payment is due within 48 HOURS of the auction close.

Delivery Information: This is a multiple site auction, please see lot description for location. We do not deliver ourselves, but our sellers can usually arrange delivery on request – please note that any delivery arrangements must be made directly with our clients AFTER invoices have been settled.

VAT: Most items in this sale will be subject to VAT. Any lots which are not subject to VAT will be shown in the lot description. Please note that VAT is always payable on the Buyers Premium.

Before You Bid:

Please be aware that once you bid you are legally bound to pay your invoice, bids placed in auction cannot be removed afterwards. If you are unsure do not bid. 

  • All Lots are subject to a Buyers Premium as stated:
    • Hammer Price (per lot) up to £500 - 15%
    • Hammer Price (per lot) £501-£8,000 - 10%
    • Hammer Price (per lot) £8,001 and above - 5%
  • All lots are also subject to a 3% Online BIdding charge levied by BIdspotter/iBidder
  • Payment sent from outside the UK will be subject to a £15 surcharge to cover bank charges
  • Payment is to be made via direct Bank Transfer, within the dates stated above – account details will be sent with invoices. We do not accept card payment other than in person by chip and pin at our premises.
  • If you are exporting goods won in auction, the VAT on Hammer must be paid first, and will only be refunded on receipt of proof of export (which must be received within 28 days of the auction end)
  • Please note that late payment and collection fees will be added where applicable
  • This is a business-to-business, not retail, sale; the Sale of Goods Act does not apply
  • Please note that all bids are final. Even where reserves are not met, highest bids will be submitted to the seller for approval; if the seller approves then the sale is deemed to be binding at the highest bid made.
  • All lots must be collected (by appointment) within 14 days of the auction; any lots not collected will be subject to additional handling/storage charges

Bidding Conditions: PLEASE REMEMBER THAT YOU ARE BIDDING TO BUY - AT THE END OF THE AUCTION, THE WINNING BID IS CONTRACTUALLY BINDING (SUBJECT TO OTHER BIDS AND ANY RESERVE). The auctioneers reserve the right to bid on vendors behalf up to any reserve. Should the vendor remove any reserve prior to the end of the auction, bidding may be "rolled back" by one or more bids to the highest bid below the reserve price. All bids are agreed to be binding even if a higher bid is placed and then later removed.

 

IMPORTANT BIDDING NOTICE: Your Highest Bid will be treated as a valid and binding bid even if at the time of placing it the RESERVE is NOT MET. Even if a reserve is not met, at the end of the auction highest bids will be considered as binding offers and forwarded to the vendor for consideration; any reserve may be reduced accordingly, in which case the highest bidder will be the buyer. Remember when placing a bid you are bidding to buy!

 

Buyers Premium: Premium is charged on top of the purchase price on a sliding scale, at the rates below:

Hammer Price (per lot) up to £500 - 15%

Hammer Price (per lot) £501-£5000 = 10%

Hammer Price (per lot) £5001 and above 5%

Online Bidding Charge of 3% applies to all lots.

Deposits: No deposit is required to register for this auction, although please note that the auctioneers reserve the right should they deem it in their clients' interests to request deposit from any bidder unknown to them at any time either during or after the end of the auction.

 

Payment: Full payment must be made within 48 hours of the auction closing. All payments to be made by direct bank transfer (details will be provided on our invoice) please note that card payments are not accepted by phone, and Credit Cards are no longer accepted as payment. IF PAYMENT HAS NOT BEEN RECEIVED WITHIN 48 HOURS OF THE AUCTION CLOSE, THE AUCTIONEERS RESERVE THE RIGHT TO TAKE FULL OR PART PAYMENT (AS DEPOSIT) FROM YOUR REGISTERED CARD.

Collection: Collection of purchased lots is BY PRIOR APPOINTMENT ONLY. Full collection addresses and contact details will be provided (by email) once payment is received. All lots must be collected strictly WITHIN 14 DAYS of the auction ending unless by prior arrangement. Any lots not collected by that date will be considered forfeited and resold or disposed of, and any funds retained to cover storage and handling costs.

 

VAT: All items in this auction are subject to VAT at the standard rate unless otherwise stated in the item description. If a lot is stated to be non-VAT, the sale will be made under the Auctioneers (Margin) Scheme which means that the lot is exempt from VAT but any premium will be subject to non-recoverable VAT under that scheme. Please see the important notes below concerning export buyers.

 

Export VAT: Please note that all overseas and EU buyers wishing to have their invoices issued at zero VAT rate will be required to pay a deposit equivalent to the VAT chargeable on their invoice, which will be refunded on receipt of valid original proof of dispatch (EU) or export (non-EU) which must be received within 28 days of the auction close date. The buyers address must also be outside the UK. This policy will be applied to ALL INVOICES; we will not zero-rate any invoice unless these conditions are met.

 

IMPORTANT NOTICE

Errors & Omissions: Details of lots are provided in good faith, notwithstanding that there is no guarantee or warranty offered as to condition, hours shown, year of manufacture, etc - all items are sold strictly as seen and found, and contract to sell/buy is concluded at the fall of the hammer or close of the online auction. The condition and function of an item should be confirmed by the bidder, prior to bidding. We are happy to assist as far as possible with providing extra details of lots, and viewing (by appointment) is recommended. There will be absolutely NO Refunds or Allowance given after the closure of the bidding process and no returns or claims will be entertained under any circumstances once lots have been removed. Your bid is your commitment to purchase. No warranty is offered or implied on any item. Each lot is bought and sold as seen.

 

GENERAL CONDITIONS OF SALE AND TERMS OF BUSINESS

Norfolk Machinery Auctions (NMA) carries on business with bidders, buyers and all those present in the auction room prior to or in connection with a sale on the following General Conditions and on such other terms, conditions and notices as may be referred to herein.

1. Definitions: In these conditions:

(a) 'Auctioneer' means Norfolk Machinery Auctions (NMA) or its authorised auctioneer, as appropriate (b) 'Deliberate forgery' means an imitation made with the intention of deceiving as to authorsip, origin, date, age, period, culture or source but which is unequivocally described in the catalogue s being the work of a particular creator and which at the date of the sale had a value materially less than it would have had if it had been in accordance with the description (c) 'Hammer price' means the level of bidding reached (at or above any reserve) when the auctioneer brings down the hammer (d) 'Terms of consignment' means the stipulated terms and rates of commission on which Blyths accepts instructions from sellers or their agents (e) 'Total amount due' means the hammer price in respect of the lot sold together with any premium, Value Added Tax chargeable and any additional charges payable by a defaulting buyer under these conditions (f) 'Sale proceeds' means the net amount due to the seller, being the hammer price of the lot sold less commission at the stated rate, Value Added Tax chargeable and any other amounts due to us by the seller in whatever capacity and however arising (g) 'You', 'Your', etc. refer to the buyer as identified in Condition 2 (h) The singular includes the plural and vice versa as appropriate.

2. Bidding procedures and the buyer:

(a) Bidders are required to register their particulars before bidding and to satisfy any security arrangements before entering the auction room to view or bid (b) The maker of the highest bid accepted by the auctioneer conducting the sale shall be the buyer at the hammer price and any dispute about a bid shall be settled at the auctioneer's absolute discretion by re-offering the lot during the course of the auction or otherwise. The auctioneer shall act reasonably in exercising this discretion (c) Bidders shall be deemed to act as principals. (d) Once made, no bid may be withdrawn. Our right to bid on behalf of the seller is expressly reserved up to the amount of any reserve and the right to refuse any bid is also reserved. All bids are binding in the event of a reduced reserve or a withdrawn higher bid.

3. Increments: Bidding increments shall be at the auctioneer's sole discretion.

4. The purchase price: The buyer shall pay the hammer price together with a premium thereon of the advertised rate, which shall be subject to VAT on the premium at the rate imposed by law.

5. Value added tax: Value Added Tax on the hammer price is imposed by law on all items so notified in advance of or at the time of sale. Value Added Tax is charged at the appropriate rate prevailing by law at the date of sale and is payable by buyers of relevant lots.

6. Payment:

(1) Immediately a lot is sold you will: (a) give to us, if requested, proof of identity, and (b) pay to us the total amount due in cash or in such other way as is agreed by us.

(2) Any payments by you to us may be applied by us towards any sums owing from you to us on any account whatever without regard to any directions of you or your agent, whether express or implied.

7. Title and Collection of purchases:

(1) The ownership of any lots purchased shall not pass to you until you have made payment in full to us of the total amount due.

(2) You shall at your own risk and expense take away any lots that you have purchased and paid for immediately following the auction or upon the clearance of any cheque used for payment after which you shall be responsible for any removal, storage and insurance charges.

(3) No purchase can be claimed or removed until it has been paid for.

8. Remedies for non-payment or failure to collect purchases:

(1) If any lot is not paid for in full and taken away in accordance with these conditions or if there is any other breach of these conditions, we, as agent for the seller and on our own behalf, shall at our absolute discretion and without prejudice to any other rights we may have, be entitled to exercise one or more of the following rights and remedies: (a) To proceed against you for damages for breach of contract (b) To rescind the sale of that lot and/or any other lots sold by us to you (c) To resell the lot (by auction or private treaty) in which case you shall be responsible for any resulting deficiency in the total amount due (after crediting any part payment and adding any resale costs). Any surplus so arising shall belong to the seller (d) To remove, store and insure the lot at your expense and, in the case of storage, either at our premises or elsewhere (e) To charge interest at a rate not exceeding 1.5% per month above Lloyds Bank base rate on the total amount due to the extent it remains unpaid for more than three working days after the sale (f) To retain that or any other lot sold to you until you pay the total amount due.

(g) To reject or ignore bids from you or your agent at future auctions or to impose conditions before any such bids shall be accepted (h) To apply any proceeds of sale of other lots due or in future becoming due to you towards the settlement of the total amount due and to exercise a lien (that is a right to retain possession of) any of your property in our possession for any purpose until the debt due is satisfied.

(2) We shall, as agent for the seller and on our own behalf pursue these rights and remedies only so far as is reasonable to make appropriate recovery in respect of breach of these conditions

(3) Any invoice remaining unpaid 48 hours after the end of the auction will be subject to a £20 administrative charge, and sent for recovery action. This will involve significant costs being added to the outstanding account. Any invoice remaining unpaid after 28 days will be referred without notice to court action, please note that all legal costs will be the responsibility of the original bidder. The auctioneers reserve the right to request a deposit from any bidder either during or after the auction.

9. Third party liability:

All persons attending the Auctioneers or the Auctioneers’ Clients’ premises are there at their own risk and must note the lay-out of the accommodation and security arrangements, putting in place any risk assessment and/or health and safety procedures which may be necessary. Accordingly neither the auctioneer nor our employees or agents shall incur liability for death or personal injury (except as required by law by reason of our negligence) or similarly for the safety of the property of persons visiting prior to or at a sale.

10. Online Bidding

We offer an online bidding service via our the Bidspotter.co.uk, iBidder.com, and/or other third party websites. The Auctioneers will not be held liable for any technical or other issue with these websites which prevent bids from being submitted. In completing the bidder registration process (and in some cases providing your credit card details) you explicitly authorise the auctioneers to charge the card given in part or full payment, including all fees, for items successfully purchased in the auction, if alternative arrangements are not made

11. Warranty of title and availability:

The seller warrants to the auctioneer and you that the seller is the true owner of the property consigned or is properly authorised by the true owner to consign it for sale and is able to transfer good and marketable title to the property free from any third party claims.

12. Agency:

The auctioneer acts as agent only to facilitate the sale of the lots, and disclaims any responsibility for default by sellers or buyers.

13. Terms of sale:

The seller acknowledges that lots are sold subject to the stipulations of these conditions in their entirety and on the 'Terms of consignment' as notified to the consignor at the time of the entry of the lot. The seller particularly acknowledges that he has good title to the goods offered and will complete the transaction as defined under the terms and conditions.

14. Descriptions and condition:

(1) Whilst we seek to describe lots accurately, it may be impractical for us to carry out exhaustive due diligence on each lot. Prospective buyers are given ample opportunities to view and inspect before any sale and they (and any independent experts on their behalf) must satisfy themselves as to the accuracy of any description applied to a lot. Prospective buyers also bid on the understanding that, inevitably, representations or statements by us as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price involve matters of opinion. We undertake that any such opinion shall be honestly and reasonably held and accept liability for opinions given negligently or fraudulently. Subject to the foregoing neither we the auctioneer nor our employees or agents nor the seller accept liability for the correctness of such opinions and all conditions and warranties, whether relating to description, condition or quality of lots, express, implied or statutory, are hereby excluded. Any question of material accuracy of description must be taken up with the vendor and auctioneer prior to collection, once items have been removed from the vendors premises there can be no redress whatsoever.

(2) Private treaty sales made under these conditions are deemed to be sales by auction for purposes of consumer legislation.

General:

15. We shall have the right at our discretion, to refuse admission to our premises or attendance at our auctions by any person, or online registration or submission of online bids, without being required to give explanation.

16 (1) any right to compensation for losses liabilities and expenses incurred in respect of and as a result of any breach of these conditions and any exclusions provided by them shall be available to the seller and/or the auctioneer as appropriate; especially in the case of non-payment by the Buyer, the Auctioneer shall be entitled to redress including but not limited to the Buyers Premium and any VAT thereon together with all costs incurred in recovery.

(2). Such rights and exclusions shall extend to and be deemed to be for the benefit of employees and agents of the seller and/or the auctioneer who may themselves enforce them.

17. Any notice to any buyer, seller, bidder or viewer may be given by first class mail in which case it shall be deemed to have been received by the addressee 48 hours after posting.

18. Any indulgence extended to bidders buyers or sellers by us notwithstanding the strict terms of these conditions or of the 'Terms of consignment' shall affect the position at the relevant time only and in respect of that particular concession only; in all other respects these conditions shall be construed as having full force and effect.

19. For the avoidance of doubt, the 1979 Sale of Goods Act (as amended) does not apply to items sold at our auctions, as these are “business to business” transactions. No refund is possible unless the description of the lot is materially incorrect.

20. GDPR and Data Protection: In registering for the auction, you confirm your authorisation to retain your contact details and request that the auctioneers send you updates from time to time of sales and services you may be interested in, you may opt out of this at any time by emailing us.

21. English law applies to the interpretation of these conditions.
