1.            Introduction

These Online Auction Terms and Conditions govern online auction sales by AFS Ground Support Services Ltd. They should be read in conjunction with the Sales Details / Important Information published for each individual auction. In the event of a conflict, and unless we state otherwise, these Terms and Conditions take precedence.

2.            Pricing

All prices are denominated in pounds sterling (GBP).

A buyer’s premium will be added to the price of winning bids. The amount of the premium will be specified in the auction details.

Unless otherwise stated in the auction details, VAT at the standard UK rate (currently 20%) will be added to the price of winning bids and the buyer’s premium. VAT charged to EU buyers providing a valid VAT number will be refunded on production of export documentation. Refunds to buyers outside the EU will be on proof of export.

3.            Amendments to Advertised Lots

AFS Ground Support Services may withdraw or amend any advertised Lot, or alter the reserve price, at any time prior to auction closure.

4.            Storage Location

All Lots are sold ex storage location.

Unless otherwise stated, Lots are stored at the following location:

Alton

Hampshire

GU34 5SP

Should any Lots be stored elsewhere, this will be clearly marked in the Lot description.

5.            Viewing

Viewing is by appointment. Buyers should email or telephone us to make arrangements.

All visitors are required to carry photo ID and comply with Health & Safety regulations.

6.            Warranty

All Lots are sold as seen. No warranty is implied or given. Buyers are advised to inspect any Lot for which they intend to bid.

7.            Irrevocability of Bids

Buyers’ bids constitute a legally binding commitment to purchase. This applies even if at the time of bidding the reserve price has not been met. Bids cannot be cancelled or altered once the auction has closed.

8.            Payment

Full payment must be made in GBP within seven working days of the end of the auction.

Acceptable methods are bank transfer and Visa or MasterCard debit/credit card. Buyers are responsible for any banking fees and exchange rate differences. Payments by credit card will be subject to a 3% surcharge. Cleared funds will be required before collection.

9.            Collection           

All Lots must be collected within fourteen days of the end of the auction, otherwise storage charges will apply. Buyers should email or telephone us to make arrangements.

Courier services can usually be arranged at the buyer’s cost plus an administration fee.

Lots will not be released for collection until all charges, including storage and courier charges where applicable, have been paid in full.

All visitors are required to carry photo ID and comply with Health & Safety regulations. Buyers are responsible for any loss or damage caused by themselves or their agents in connection with collection of Lots.

10.            Risk and Title

The risk of damage or loss of purchased Lots transfers to the buyer once the goods have been released for collection.

The title of purchased Lots transfers to the buyer once full payment of all charges has been made and the goods have been released for collection.

11.            Late Payment / Storage Charges

Buyers are liable for a late payment/storage charge of £25.00 plus VAT per Lot per day (whether or not the Lot has been paid for), starting fourteen working days after the date on which the auction ends and continuing until the Lot is collected or sold.

Lots will not be released until all charges have been paid in full.

12.            Default in Payment, Failure to Collect Goods

If the buyer fails to make payment and collect the goods within a reasonable period of time, AFS Ground Support Services reserves the right to remove, sell or otherwise dispose of them and to charge the buyers with costs incurred.

13.            Errors and Omissions

Details are provided in good faith but should not be relied on as fact. Buyers should make their own investigations where accuracy or authenticity of stated criteria or descriptions are important.  Buyers who do not inspect Lots prior to bidding do so at their own risk.

A buyer’s bid is a commitment to purchase, not to negotiate. No refunds or allowances will be given after the auction has closed. Non-compliance with these conditions will be reported to BidSpotter, and the buyer may be blocked from taking part in any future BidSpotter sales.

14.            Limitation of Liability

Other than where required by law, AFS Ground Support Services Ltd shall not be liable in any way in respect of any injury, damage or loss, however caused, connected with the purchase and collection of auctioned goods.

15.            Applicable Law

These Terms and Conditions and the relationship between you and AFS Ground Support Services Ltd shall be governed by and construed in accordance with the Law of England and Wales and AFS Ground Support Services Ltd and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
