Terms and conditions 

It is important that users of this website read and understand our terms before using our services. By accessing or using our services, you agree to be legally bound by these terms. We reserve the right to change these terms at any time. Amendments will take effect when posted on this website.  If you do not agree to said terms, please refrain from using e Auctions Ltd services and website.

1. Basis of Use

1. e Auctions Ltd provides online auction facility services through which you can bid for vehicles and items provided by third parties. The third parties can range from sole traders, companies and other corporate entities.

2. All the vehicles (or any other type of goods) displayed in “Our Auctions” section on this website or on our dedicated page on iBidder.com do not belong to us but are the property of third parties. 

3. e Auctions Ltd  is acting solely as the agent of sellers of the vehicles (goods) auctioned. We are not responsible for any default by the seller.  

4. Lot details are provided in good faith, with information available at the time of listing. Description is based on the information provided to us by the seller.

5. Lot details provided on our website and on our dedicated iBidder web page are not to be read as a statement or representations of fact, but as a general guide, they may be revised at any time with new information provided to us by the seller. Buyers must conduct their own investigations and due diligence on our lots. e Auctions Ltd does not bear any responsibility for possible errors in the description of its lots.The Content, commentary and other materials displayed on the Website are not intended to amount to advice on which reliance should be placed. e Auctions  disclaims all responsibility and liability arising from any reliance placed on such materials by any User of the Website, or by anyone who may be informed of the Content. Notwithstanding the above, the Content and all other material displayed on the Website is subject to the exclusions of liability set out in these Website Terms and the User should not rely on the Content or other material displayed on the Website as being accurate or up to date but should independently verify all information.

6. By bidding on e Auctions Ltd lots, the buyer acknowledges that they are satisfied by the information provided the description and are aware that seller makes no representation or warranties in any manner, and buyer agrees to our auction terms and indemnifies seller and e Auctions Ltd against any claims.

7. The Sale of Goods Act 1979 does not apply to this auction. By bidding on our lots, the buyer acknowledge that they are acting as trade purchasers, not consumers.

8. e Auctions Ltd employees have no authority to make or give any representation or warranty in relation to any lot.

9. If buyer bids for the item auctioned through e Auctions Ltd, they acknowledge and agree that if the highest bid placed (and such bid equal or exceeds a reserve price (if applicable) or “Buy it now” price is offered to be paid (if applicable)), at the point at which the auction ends (or at the point at which buyer’s “Buy it now” bid is accepted),a contract of sale will be formed between the buyer and the seller. e Auctions Ltd, however, will not be a party to or have any liability of whatever nature under that contract

10. e Auction Ltd reserves the right, at our sole discretion, to suspend, cancel or extend an auction at any time.

2. Limitation of Liability

1. e Auctions Ltd will not under any circumstances be liable for any compensation nor be responsible for the condition of goods sold through us.The Content is provided for general information only. Any advice or information received through this Website or its Content should not be relied upon as being correct or accurate as it is the User's obligation to verify independently such matters from primary sources of information and/or by taking professional advice.

2. The User is not entitled to rely on the Content, the Service or any associated service of the Website.

3. Except in the case of death or personal injury arising from the e Auctions Ltd  own negligence or for  e Auctions Ltd fraud, e Auctions Ltd excludes all liability in contract, tort (including negligence), breach of statutory duty or otherwise for any costs, losses, claims, damages, expenses or proceedings incurred or suffered by the User arising directly or indirectly in connection with the Website and its Content including without limitation any loss, damage or expense arising from, but not limited to, any defect, error, imperfection, fault, mistake or inaccuracy with the Website, its Content, the Service or associated services (including but not limited to information, advice, and all content and software downloaded from this Website), or due to any unavailability of part or all of the Website or any Content, the Service or associated services.

4. For the avoidance of doubt, all liability of e Auctions Ltd  for loss of profits, economic loss, wasted management time, special, incidental, indirect, and/or consequential loss or damage, is also expressly excluded to the fullest extent permitted by law.

5. e Auctions Ltd  accepts no liability or responsibility for the use made of the Services by the User or those under its control and, in particular but without limitation, the content of any information.

6. The exclusions and limitations of liability in these Website Terms are also for the benefit of the Website Operator’s affiliates (if any)

3. Indemnification

1. By bidding on e Auctions Ltd lot, the buyer agrees to indemnify and keep indemnified, defend and hold us, e Auctions Ltd,  harmless from any and all damages, losses, liabilities, costs, expenses, actual expense (including legal fees) or claims made by the buyer arising from any unfortunate event that might have occured in the result of buying any of our lots.

4. For buyers

1. All bids must be provided to e Auctions Ltd through the iBidder platform, therefore, before placing bids buyers shall get acquainted with iBidder’s terms and conditions and register there to bid on e Auctions Ltd lots. 

2. Our lots are sold  without warranty and it shall be implied that it is sold with all faults, imperfections and errors of description and the buyer shall have no right to return the lot to claim damages or to do any other remedy of whatsoever nature. The exception to this being when the seller has provided e Auctions Ltd  with the description of the lot (see P. 1.4 and 1.5) that is incorrect or false. In this situation the Buyer is entitled to make the sale void. Where buyers claim that an incorrect statement has been made in relation to a sale, this must be notified to the e Auctions Ltd within 24 hours of the purchase.

3. Our buyers’ premium is 15%+VAT

4. The title to the item purchased shall not pass to the buyer until they have made payment in accordance with paragraph 5 of these T&C and collected the vehicle in accordance with paragraph 5.3. Until title passes, the vehicle shall remain the property of the seller.

5. For sellers

1. Upon listing a lot with e Auctions Ltd, the seller undertakes that:

1. they are the owner of the vehicle or have valid documented authority from the owner to sell the vehicle

2. they acknowledge the restrictions on the number of times and a duration of time a lot can be listed for sale as it is stated our auction sales agreement

3. that they have not broken any civil or criminal laws to obtain or sell said vehicle

2. The Auctioneer, the Company and/or the vendor is not bound to accept the highest bid or any other bid placed in the course of the auction.

3. Sellers are required to provide e Auctions Ltd with the description of the lot which could be then published together as advised by the seller with the lot’s pictures on e Auctions Ltd website and dedicated e Auctions Ltd iBidder page.

4. It is the duty of the seller to ensure the vehicle (any type of goods sold via e Auctions Ltd) is insured against third party damage and/or theft or any relevant liability  whilst on e Auctions’ premises or otherwise in E-Auctions’ Ltd control and shall remain insured until risk passes to a buyer upon acceptance. The Risk whilst the vehicle  is in the lot remains with the seller at all times until the ownership of the lot is passed to the buyer.

5. The seller is solely liable for the content of the lot's description and e Auctions Ltd is sometimes unable to thoroughly check the information contained in any such description. 

6. The seller gets paid within 24 hours after the money paid by the buyer are received by e Auctions Ltd

6. Auction rules

1. All bids must be provided to e Auctions Ltd through the iBidder platform. e Auctions Ltd only conducts timed auctions.

Highest Bid

2. Once a buyer has made a bid for the lot on e Auctions Ltd i-bidder page, it cannot be withdrawn and is binding on the buyer for the purposes of these terms and conditions. Upon making a bid for the lot, the buyer is agreeing to purchase the auctioned lot for the price offered in the event that it is the highest bidder. Once a bid has been accepted by a seller the buyer is bound to the seller to complete the transaction and pay the purchase price offered.

3. Items being auctioned may have a reserve price (as shown on the E Auction Ltd iBidder page). If the reserve price is not met, then the seller will not be obliged to sell the vehicle 

4. It is possible to arrange viewing of the offered lots. Viewings are by appointment only. However, viewing can be only in the form of a visual inspection. 

Buy it now

5. It is possible for the seller to offer its lot as a Buy it now item. The amount listed as part of the Buy it now offering on e Auctions Ltd iBidder page is the amount for which the Buy it now item is immediately available for purchase by a Buyer.

6. A buyer can initiate a Buy it now purchase by submitting an offer for a Buy it now item on the e Auctions Ltd iBidder page. Once a buyer has made an offer for a Buy it now lot the offer cannot be withdrawn, and the buyer is bound to the seller to complete the purchase of the Buy it now Vehicle (or item) for the purposes of these terms and conditions.

7. Upon listing a Buy it now lot on the e Auctions iBidder page, the seller agrees to sell a Buy it now lot to the Buyer should an offer be made for the advertised price.

7. Payments and collections

1. Payments for the lots are to be made in full by the end of the following working day (5 PM). Shall there be any delay with the payment additional charge of £20 per day+ VAT will be added to the lot’s price.

3. All the won items must be collected within 5 working days. e Auctions Ltd will charge additional £25 per day+VAT after that as a storage fee.

4. Items not collected within 30 days will be considered abandoned. 

5. e Auctions Ltd accepts no liability for the items intentionally or unintentionally left on its premises and for payments made to the wrong account

8. Relations with iBidder

1. e Auctions Ltd do not accept any liability of any nature as a result of any failure by iBidder to provide us with accurate information regarding the buyer or their bid, or for failure by iBidder to communicate with buyer regarding their bid and the status of their bid, or for any failure by iBidder to provide us with information relating to buyer or a bid made by buyer, or for any information on the iBidder website (including but not limited to information regarding the items we are auctioning being inaccurate) or for any faults or lack of availability of the iBidder website or for the contents of the iBidder website generally.   

2. e Auctions Ltd reserves the right, at our sole discretion, to refuse any bid placed by buyers. 

3. We will consider the bid placed by a particular iBidder account holder even in case this account holder’s details were used by someone else to place the bid.

4. iBidder will keep the buyer updated as to the status of their bid, including letting the buyer know if someone has put in a bid which is higher than a bid made by them.  If you have been successful in your bid, you will be notified of this by iBidder. e Auctions Ltd will also contact the buyer if their bid is successful to provide them with our invoice and information about when to collect the item. 

9. Information Security

1. e Auctions Ltd takes the security of data very seriously. We work hard to protect other information you provide from loss, misuse, and unauthorized access or disclosure. These steps take into account the sensitivity of the other Information we collect, process and store. 

2. Given the nature of communications and information processing technology, e Auctions Ltd cannot guarantee that information during transmission through the Internet or while stored on our systems or otherwise in our care will be absolutely safe from intrusion by others. When you click a link to a third-party site, you will be leaving our site and we don’t control or endorse what is on third-party sites.

10. Ancillary provisions

1. Severability - If any of the provisions or part of a provision of these Website Terms is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions or provision will not be prejudiced unless the substantive purpose of these Website Terms is then frustrated, in which case either party may terminate the Agreement forthwith on written notice.

2. Waiver - No forbearance or delay by either party in enforcing its respective rights will prejudice or restrict the rights of that party, and no waiver of any such rights or of any breach of any contractual terms will be deemed to be a waiver of any other right or of any later breach.

3. Assignment/sublicensing = The User may not assign or sublicense the Agreement or any benefits or interests arising under these Website without the prior written consent of e Auctions Ltd.

4. Governing law and jurisdiction - These Website Terms (and accordingly all visits to the Website) shall be governed by the law of England and Wales and the parties submit to the exclusive jurisdiction of the English Courts. This is without prejudice to the Website Operator's right and that of its affiliates to commence proceedings anywhere in the world relating to the protection of its Intellectual Property Rights or those of its Licensors.
