CONDITIONS OF SALE BY ONLINE AUCTION
These conditions in addition to specific sale conditions in the notice to purchasers form the only basis of a sales contract between the Auctioneer “Plastic Machinery Sales” and the bidder. In registering for this sale through Bidspotter the bidder is deemed to have accepted these conditions
General
1) All lots are sold as is where is with no guarantee or warranty. All statements and descriptions as to condition, fitness for purpose and accuracy are expressly excluded. The bidder is strongly advised to inspect the equipment, in order to satisfy themselves in these regards.
2) Title to the lots does not pass until payment is received in full and cleared. Payment can be by bank transfer, cash (Up to a maximum of £7,500) or cheque. Cheque payments should be made in good time to allow clearance through our bank
3) Unless stated to the contrary in the lot description or notice to purchasers, all decommissioning and loading of the lots is the sole responsibility of the purchaser. Qualified contractors if appropriate should be employed to undertake this work and the Auctioneers reserve the right to request method statements, risk assessments and proof of adequate insurance and qualifications. Collection of lots once payment has cleared is by appointment with the Auctioneer and all lots must be collected in line with the timescales outlined in the notice to purchasers. Any failure to comply may incur additional charges
4) Once invoiced, risk to the lot(s) purchased passes to the purchaser who is strongly advised to effect insurance with immediate effect
5) A buyers premium of 13% is added to each successful bid. This is non negotiable and forms part of the sales contract
6) VAT is levied on all applicable lots and the buyers premium at the prevailing rate currently 20%. Overseas buyers who are exporting will have the VAT refunded upon receipt of a certified Bill of Lading
7) The Auctioneer reserves the right to amend or cancel any sale whilst the lot(s) are still in their possession. The bidder will be entitled to a full refund in the event of cancellation and this is the limit of any claim for liability
