1.. The purchaser is responsible for arranging all shipping and removal from the site once full payment has been made. 

2.  The purchasor is responsible for paying the the full UK VAT to the auctioneers. 

3.  The purchasor id responsible for all export costs and obtaining all correct paperwork.

3. The vendor will disconnect all in situ electrical items on Thursday 11th May ready for removal but it is important to check that all items are safe before starting to remove for situ.

LOCATION – From the A12 follow signs onto the A120 East towards Harwich/Clacton A133.  Keep right and continue forward onto the A120 for Harwich.  At the roundabout take 2nd exit and stay on the A120.  At the next roundabout take the 2nd exit and stay on the A120.  Turn right onto Harwich road and turn left towards Oakley Road and turn right onto The Avenue after 1.3 miles.  Turn right onto restricted usage road and the destination will be on the right.

The sale ground will be signposted on the sale day and the nearest postcode is CO12 5BN.

All persons attending the sale ground are reminded that there may be risks on the site including moving machinery and vehicles and to exercise caution at all times with any children being fully supervised at all times. Any incidents that occur on the sale ground should be reported immediately to a representative of Stanfords for details to be recorded. No vehicles will be permitted onto the sale ground during the sale.

PAYMENT - All lots become the sole risk of the buyer at the fall of the hammer. The property in a lot purchased shall not pass to the buyer or be removed until payment has been cleared of the full purchase price (including commission and VAT) to the auctioneers. All lots must be paid for upon the receipt of the invoice sent by the auctioneers and within 1 week of the sale date.

CHEQUE PAYMENTS - Buyers unknown to the auctioneers wishing to pay by cheque with immediate clearance must be accompanied by a written Bank reference for a sum equal to or in excess of the total invoice. The reference must specify the sale location, date, the account details upon which the cheque will be drawn and the amount up to which their cheque will be honoured. We are able to accept VISA debit cards only. Payments by credit card are not acceptable. In order to comply with Money Laundering Regulations 2017 we are unable to accept cash payments for sums in excess of £7,500 either as a single payment or multiple payments totalling £7,500.

REMOVAL OF LOTS - No lots may be removed from site unless accompanied by a receipted invoice. All lots are to be removed by Wednesday 17th May 2023. Arrangements can be made for removal of large in situ items by agreement with the vendor.

LOADING FACILITIES - Loading facilities will be available until 5pm on Wednesday 17th May. Removal of large in situ items to be arranged by the vendor. The Auctioneers and Seller will not accept any responsibility or liability for the loss or damage to lots left on the sale ground and all Buyers are reminded that they are entirely responsible for any lot purchased from the fall of the hammer. Vehicles entering the sale ground for loading must operate below a 5mph speed limit and move with caution.

REGISTRATION: - All buyers MUST register before bidding.  Bidding will be by number only, obtainable on registration on the day of sale only.

BUYER’S PREMIUM – There will be no Buyers Premium.

ONLINE BIDDING - Live online bidding will be available at this sale via i-bidder.com or bidspotter.co.uk. A 8% plus VAT internet surcharge will be added to the hammer price for successful bids made online. We recommend that registration for online bidding is made before the day of the sale. Stanfords accepts no liability whatsoever for any loss of connectivity and the ability to bid on the day of the sale and strongly recommends attending the sale in person to ensure that ability to bid is maintained.

VAT – All lots included within this auction are subject to VAT. VAT will be payable on the internet surcharge for online bidding.

CONDITIONS - The sale will be conducted under our standard Conditions of Sale reproduced in this catalogue. All prospective Buyers should ensure that they have read and understood those Conditions. The act of bidding will be taken as acceptance of them.

REFRESHMENTS - These will be available on the sale day.

COMMISSIONS - The Auctioneers will be pleased to take written commission bids prior to the sale. Forms are available on request.

ENGINE HOURS - Neither the Sellers nor the auctioneers make any warranty regarding engine hours or vehicles mileages.

INSPECTION OF EQUIPMENT – No powered machinery or equipment may be started without the prior approval of a Stanfords representative.

FORTHCOMING SALES - If you wish to receive catalogues of future sales, please leave your name and full address at our pay office.

CATALOGUE ENTRIES - Whilst every attempt is made to ensure that the descriptions are accurate, no guarantees are either given or implied. Buyers should be aware that from time to time, lots are withdrawn and other lots added. Please contact the auctioneers prior to the sale to ensure that the machinery has been delivered onto the sale ground.

VIEWING – Tuesday 9th May 2023 from 10am – 4pm and on the morning of the sale from 8am.

 

Terms & Conditions

1.       Terms of payment are by cash, debit card or Bankers Draft only unless prior arrangements have been made with the Auctioneers.

 

2.       Clearance on day of sale unless payment has been made by cheque then clearance will be after the cheque has cleared or by agreement with the Auctioneers.  All Lots to be cleared from the sale area by Wednesday 17th May 2023 unless by prior arrangement with the vendor.

 

3.       The highest bidder shall be the buyer.  The Auctioneers reserve the right of regulating the bidding for, withdrawing, consolidating, dividing or altering the order of lots.  In the event of any dispute between two or more bidders the Lot in question shall be put forward again at the Auctioneer’s discretion and resold.

 

4.       The purchase money for each Lot and Value Added Tax (where applicable) shall be paid at the fall of the hammer (if required).  Each Lot at the fall of the hammer shall be at the sole risk and expense of the buyer, and shall be paid for and removed immediately at the conclusion of the sale, but no lot shall become the property of the buyer, or be removable, until paid for, and if taken away in contravention of these conditions without an order for removal signed by the Auctioneers, they shall have the power to seize the same by their servants or agents, or otherwise, or the Auctioneers may recover either the Lot sold of the price thereof (at their option) by action of Law.

 

5.       No contra account of any description whatever will be allowed to a buyer as a set off, and payment for each Lot shall be made to the Auctioneers or their Clerks only and a buyer paying by cheque must give satisfactory references (if required).  All Lots are sold for cash, debit card or Bankers Transfer before delivery unless a previous arrangement has been made with the Auctioneers.

 

6.       For all purposes of this sale the Clerks of Auctioneers shall be deemed to be the Agents of both Seller and Buyer.

 

7.       A Bidder shall not be allowed to retract his bidding, and he shall give his full name and address if required.  The Auctioneers will not recognise the transfer of any Lot from one Buyer to another, not make any alteration in the sale book in respect thereof.  In any case of any transfer without the Auctioneers consent the original Purchaser shall be held responsible for the purchase money.  At the fall of the hammer the lot is at the absolute risk of the purchaser.

 

8.       The Auctioneers are acting only as Agents, and have no personal knowledge as to the correctness or otherwise of the description of the property offered for sale and give no personal warranty as to the health, condition, quality, quantity, genuineness, authenticity, or otherwise.  Each Lot is therefore sold with all defects and errors of description, if any.  The Purchaser is deemed to have inspected the Lot he buys, and if he buys without previous inspection he shall have deemed to have done so at his own risk.  All Lots purchased are taken with all faults, imperfections and errors of every description.

 

9.       The Auctioneers shall be the sole Arbitrators in all matters of dispute relating to these conditions, both as the seller and buyer and between the several bidders and buyers and their determination on all matters shall be final and binding on all parties concerned.

 

10.    The property in each and every Lot shall until sold be at the absolute risk of the Vendor and the Auctioneers will not accept responsibility of any loss or damage caused by any means other than proved negligence on the part of their servants.

 

11.    Should the delivery of a Lot or Lots be obtained by the Tender of a cheque which all be unprovided for, the person giving the cheque shall be liable to prosecution for obtaining goods by false pretences.  The Auctioneers disclaim responsibility for default by either the Vendor or Purchaser acting as Agents in the sale of goods only.

 

12.    The Auctioneers give no warranty as to the Vendors title and hereby state that a purchaser shall receive only as good a title as the Vendor can give and if that is no proper title at all the Purchaser shall have no claim whatsoever against the Auctioneer.

 

13.    VAT is applicable on all lots unless mentioned at the time of sale. 

 

14.    The Health and Safety at Work Act, Factory and Machinery Regulations act and all other Acts applicable to safety.  Purchasers are reminded of the provisions of the above Acts regarding the safeguarding of machinery and implements and that some of the machinery sold at this sale may not immediately comply with the regulations issued thereunder.  It is an offence to use any machinery which does not comply with the Regulations laid down in the Acts and Regulations, and accordingly it is a condition of the Contract of Sale that the purchaser shall undertake to comply with the Acts and Regulations relating to such machines and implements as he shall purchase.  Please note the purchasers will be held responsible for any damage caused by the removal of any purchases.

 

15.    If any buyer neglects or refuses to comply with the above conditions or any of them, his deposit money (if any) shall be forfeited and the Lot uncleared may, at the option of the Auctioneers, be re-sold without notice by public auction or private contract and any loss occasioned by such re-sale together with all expenses attendant thereon, or arising under these conditions, shall be paid for by the defaulter at this sale and be recoverable as and for liquidated damages.  This condition is, however, without prejudice to the right of the Auctioneers to enforce the contract made at this sale if they think fit.

18.   Any item purchased online will be subject to a 8% internet surcharge plus VAT on the hammer price.
