References to "lot" and "item" pertain to the goods appearing in this and any other event held by us. References to "Buyer" and "Winner" pertain to the person(s) placing the highest bid at the close of auction – subject to our acceptance of any winning bid.

a.) This Sale is conducted strictly in accordance with the Conditions of Sale and General Notes contained herein.

b.) All bids made for the items in this event are AS SEEN AND INSPECTED by the party submitting the Bid. Pictures are for illustration & information purposes only. If you have any questions regarding an item(s) please contact our office to ask a question (via email or phone) prior to bidding. XS Electrical will not be held responsible for any misunderstanding arising from the information provided about the lots in this event, nor for the misinterpretation of images which are used to illustrate the lots. XS Electrical advises all bidders and interested parties to view the lots during the viewing period.

c.) Each lot in this event is to be treated and sold on an individual basis and is unrelated to all other lots (unless expressly stated). All bids submitted are for the specific and complete amounts of money, and will in no way be calculated according to or related to any other bids submitted for any other lots.

d.) We reserve the right to market and sell any and all items shown in our auctions/events in any other market place before, during and after the auction has taken place (please also refer to "Item/Lot Withdrawal" section).

e.) We reserve the right to either accept or reject winning bids after the auction has finished. We are not required to explain our reason(s) for rejecting a winning bid. The highest bid placed on an item will be considered the winning bid, but this does not constitute ownership of an item. You (the bidder) do not own an item solely by virtue of being the highest bidder in the auction. You must pay for an item in full (this includes any applicable additional fees including but not limited to: V.A.T., buyer`s premium, delivery charges) before any change of ownership takes place.

f.) Any lot/item in this auction may be subject to a reserve price. We may at any time before the end of auction withdraw, divide and/or combine any lots. We may sell any lot by private sale before or after the Auction. We may reject any Bid at our sole discretion and without being required to give a reason. We shall in every respect decide how the auction is to be conducted and without being required to give a reason. XS Electrical will not be held liable (either by the vendor or prospective purchaser) in the event of any dispute due to errors, omissions or disruptions which may occur when bidding online. All prices are exclusive of any applicable Buyer`s Premium, Value Added Tax and any other fees levied by Us against the Buyer, for which the Buyer shall be additionally liable to pay to Us. We will not be held liable in the event of any dispute due to errors, omissions, disruptions or power failures which may occur when bidding online.

g.) AT THE END OF THE ONLINE AUCTION, FINAL BID AMOUNTS WILL BE SUBMITTED TO OUR OFFICE FOR APPROVAL. ANY AND ALL LOTS MAY BE SUBJECT TO A RESERVE PRICE. ABSOLUTELY NO OFFER MAY BE WITHDRAWN, AND WE ARE NOT BOUND TO ACCEPT THE HIGHEST OR ANY OTHER OFFER.

h.) Misrepresentation: whilst every effort has been made to provide accurate and reliable information, we do not warrant the information contained herein and prospective purchasers must satisfy themselves by inspection as to its correctness.

************* 1.) AUCTION / BIDDING PROCEDURE

*** Item/Lot Withdrawal *** We (XS Electrical) reserve the right to withdraw from auction any and all items in our event at any time (regardless of whether bids have or have not already been placed). However, we will only withdraw an item under exceptional circumstances - the clarification and definition of "exceptional" being decided upon by us alone. Circumstances include, but are not limited to: i) human error; ii) an item being sold privately before the end of auction. PLEASE NOTE: once the auction is over we reserve the right NOT to sell the item to the winning bidder. However, we will only exercise this right under exceptional circumstances (as before, We alone will decide what can and what cannot be defined as exceptional).

*** Bid retraction ***Placing a bid confirms that you have accepted our terms, and once a bid has been placed you have committed to buy and pay for the item in full should you be the winning bidder. Only in exceptional circumstances will we be able to retract a bid that you have placed on an item(s). If you would like to retract a bid then you must contact us immediately and we will consider your circumstances.

*** Technical Difficulties *** we are NOT and cannot be held responsible in any way for any difficulties, either technical or otherwise, which you may experience whilst using this Web site (www.bidspotter.co.uk). Such difficulties may include, but are not limited to: i) the Web site crashing; ii) your computer/PC/laptop/terminal crashing or losing power. If you are experiencing any such problems please contact Bidspotter.co.uk where appropriate. 2.)VIEWING Please refer to the event description for viewing times/dates and locations. Viewing location XS Electrical, Hull Road Warehouses, Main Rd, Eastrington, Goole, East Yorkshire, DN14 7XL.

3.)PAYMENT Payment must be received within 5 working days of the close of auction or on receipt of invoice(s) - whichever is sooner. Where possible we will send you - via email and within 24 hours of the close of auction - an invoice(s) for the item(s) you have won in our auction. We reserve the option to revoke the auction if the payment is not received within FIVE (5) days. OUR PREFERRED METHOD OF PAYMENT IS BY BANK TRANSFER. We accept CREDIT/DEBIT CARDs (there is a 2.5% surcharge on Credit card payments)

*** Credit/Debit Card *** We accept Visa and Mastercard. Please E-mail sales@xselectrical.com and we will send you details of how to pay online. Please supply your paddle number in all correspondence.

*** Bank Transfer *** Please see bank details at the bottom of the invoice. Make sure you quote your paddle number.

*** Payment on Collection *** You are welcome to pay on collection as long as collection takes place within 5 days. Collection point address: see "Contact Us". Please bring a copy of the invoice with you. Please also read the "COLLECTIONS" section below for more information. We cannot release items unless they are paid for in full including but not limited to any applicable V.A.T., buyer`s premium, collection charges, delivery charges or storage fees.

6.) BUYER’S PREMIUM A buyer’s premium (see event details via www.Bidspotter.co.uk for the exact rate) plus VAT to be paid. UK VAT (currently 20%) will be charged on the buyer`s premium.

7.) UK VAT UK VAT (currently 20%) to be added to both the final bid (on items which are VAT applicable) and the buyer’s premium.

8.) COLLECTIONS Winning bidders must pay for their items within 5 days and collect within 8 days* of the end of the auction. Collection dates, times and location are as stated in the general event information and/or the item description (if different to general dates/times/locations). These dates/times are final and the bidder agrees to collect on these dates. Only in exceptional circumstances will we change the collection dates/times, and in such cases we will do our utmost to inform all parties of any changes. Any changes will be published on www.Bidspotter.co.uk in the event page before the end of auction, and We will inform the relevant parties where possible via email/phone. When collecting an item(s), please bring a copy of the Bidspotter invoice with you. Collections from us are to be made between 0800-1500 Monday to Friday.We may consolidate pallets prior to collection and will if shipping is requested.

9.) DELIVERY OPTIONS Delivery can be arranged by e-mailing sales@xselectrical.com for a quote. Pallets vary from £43 to £70 per pallet.

10.) SHIPPING CONDITIONS Our charges are based on the number of pallets or parcels and include the cost of using postal service or courier, cost of packaging materials and cost of staff taking time to carefully pack your item. THE ITEM WILL BE POSTED TO THE ADDRESS HELD ON BIDSPOTTER UNLESS OTHERWISE ADVISED, SO PLEASE ENSURE THAT YOU PROVIDE US WITH THE CORRECT DELIVERY ADDRESS AS WE CANNOT BE HELD RESPONSIBLE FOR DELIVERIES TO INCORRECT ADDRESSES.

*** Delivery times *** We aim to dispatch your items within 3 working days of cleared payment. However, this may be longer in busier periods.

*** Delivery of large items *** There will only be one person with your delivery so please ensure that there is somebody at the destination who is able to assist with lifting. If the goods cannot be unloaded, a re-delivery charge will be levied at the same rate as the original. XS Electrical will not cover this cost. If you do not accept the postage or delivery fees, please do not bid on the auction.

11.) RETURNS All bids made for the items in this event are AS SEEN AND INSPECTED by the party submitting the Bid. We will NOT ACCEPT returns. All electrical items, unless stated otherwise are UNTESTED by us. We endeavour to present accurate, detailed information about each item. We might from time to time add to the description; if the new information precedes a bid it is part of the description. Please feel free to ask any questions you may have, during the auction and we will attempt to answer them; however, once the auction has ended we will not answer any further questions. Please remember that your winning bid constitutes a binding and enforceable contract, do not bid if you are, in any way, uncertain. Descriptions and images provided do not in any way indicate the condition of a lot. All potential buyers/bidders are strongly advised to examine personally any goods in which they are interested, before the auction takes place. A catalogue description is for guidance only, it does not imply any item is free from defect. Prospective buyers must satisfy themselves as to the physical condition of a lot.
